That is not software. That is hardware.

Explain how you'd hook this up and make it work, then?

Pretty simple to use. Capture BVH and then import into 3ds Max.

You can not apply a .bvh or a .bip to a game asset that uses bones.
You need to constrain the bones to a system biped and apply the mocap file from there.

That is what this tutorial tells you how to do. Its old so ask if you have any questions.

You can hook up the kinect to your pc (if an xbox kinect, you need the adapter, I got mine for 3 bucks) and use a program, such as MotionBuilder 2015, that comes with a plugin that can use the kinect for mocap data. You can then send the data back to max if you have the right version. Beware, though, as what you will witness will be the trashiest mocap you can ever pump out. :)

He only asked for a motion capture software that he can use with 3ds Max.

there were a few mocap programs being worked on that used 4 video cameras (go pros in their case) to capture motion. idk if there are any public programs yet... but your best bet is a microsoft kinect if you have one. http://www.kinecthacks.com/guides/kinect-mocap-tutorial-1/
